A subbie injured himself whilst texting his girlfriend near some equipment. He tripped because he was not looking where he was going as he was too busy arranging his personal life! Of course, it was his boss’s fault and the Employers Liability Insurance had to settle the negligence claim – but why?
The reason was because the Employer did not have a documented ‘no mobile phones’ policy in place, so the boss had effectively allowed the subbie to put himself in danger.
