Three days after the completion of the works he received a demand for several thousand pounds to repair the wall he had ‘damaged’ and of course the claimant was refusing to pay the bill of £1200.The prudent Tree Surgeon then sent the claimant the video with a very strong rebuttal and demanded his bill be paid within 24 hours. Not only was the claim dropped, he also received payement within a few hours.

There is a clear lesson here for all. In order to help prevent frivolous allegations of ‘damage’ whilst on site, we are reminding you of the importance of taking photos (or videos) of ‘before’ and ‘after’ when you are on site. This is particularly important if there is already visible damage to something.  These images can be vitally important to defend the ‘You’ve damaged my wall’ allegation that is coming to you soon.

If you do accidentally damage something – photograph it, so you can be sure that the repair bill is in proportion to the damage caused. Too often that broken flowerpot becomes a smashed patio door, which coincidentally needs replacing anyway!

If you have ever wondered why your business insurance costs are going up then read this but be warned it will make your blood boil.

A subbie injured himself whilst texting his girlfriend near some equipment. He tripped because he was not looking where he was going as he was too busy arranging his personal life! Of course, it was his boss’s fault and the Employers Liability Insurance had to settle the negligence claim – but why?

The reason was because the Employer did not have a documented ‘no mobile phones’ policy in place, so the boss had effectively allowed the subbie to put himself in danger.

This is the world we live in – so think carefully about allowing mobile phones on site. They are essential these days but, whilst a necessity if you need urgent medical attention, they can also hinder safety. All Employers should consider controlling the use of mobile phones as this annoying tale shows.

Another often overlooked advantage is the kudos of being a director. If you are pitching for a big contract with a national firm, then being a ‘director’ may give you more status than ‘proprietor’. After all, anybody who runs a Tree Surgery or Forestry firm also has to be a ‘salesman’.

If you are a Limited Company, it can be easier to get somebody to act on your behalf by appointing them as a Director. This can be very difficult to do if you are a sole trader. This could be useful, for example, if you wanted somebody to arrange the insurances or finances, so you can focus on other things.

There can however also be disadvantages to incorporating. Your insurance may cost slightly more, as you are now an employee. Also, your paperwork and accounts will get more complicated and costly.

When businesses are looking to grow, many will incorporate – but not all. You can find some more information about this in our Start-Up Guide but you MUST take professional advice. The government is continually changing the way we are taxed and the liability protections of being Limited are not bulletproof.
